CaffeinatedCultist's | Terms of Service Any client who agrees to these terms, whether past or future, acknowledges that we reserve the right to modify, change, or update these rules without prior notice. The client is responsible for reviewing the Terms of Service (TOS) before finalizing payment. By breaching these terms, client understands that consequences are being ineligible from commissioning CaffeinatedCultist. At the time of writing, the current TOS's word count is less than 1500 words, including titles. (0.) BEFORE COMMISSIONING US: All business inquiries should be directed to our Coordinator, Velvet, @SelfDugGrave on Telegram. You must be 18 years or older to commission us, and we will not provide artwork to minors under any circumstances. You must be of sound mind when commissioning, and no refunds will be issued if this rule is violated. Rude, impatient, demanding, aggressive, or verbally abusive behavior will not be tolerated. Unsolicited remarks or behaviors, sexual or otherwise, are strictly prohibited. We reserve the right to refuse or cancel your commission request for any reason (refer to the refund policy (4). It is the client's responsibility to collect the finished artwork directly from our Ko-Fi page, ensuring easy access for all. We will never email you. SAI/PSD base files are not provided unless otherwise agreed upon (additional fees may apply). (0a.) HOW TO COMMISSION US: For the full version, please see: Commission Info and Prices Please have the following information ready when commissioning: A clear reference image of the character(s) you desire. Ensure it is the highest quality available. We do not accept AI references under any circumstances. 3D or VR character assets may be submitted if approved, but only with a detailed palette and any other relevant information. Otherwise, your request will be denied. Provide details about your commission, including pose, expression, theme, and background preferences. If none are given, creative liberty will be taken, and no edits will be permitted. Share your PayPal email so we can send a custom invoice (see payment policy (2.) (1.) OUR PROCESS: We work on multiple commissions simultaneously and are usually open for commissions unless stated otherwise. We cannot provide estimated completion times (ETA) to reduce our stress, so we kindly ask for your patience (see WIPs and Updates policy (3.) Commissions with specific deadlines must be discussed and agreed upon before payment, and additional costs will apply. We reserve the right to decline rush commissions. Commissions involving a third party require explicit consent from said party. Surprise gifts are not accepted. For additional understanding into our post-process workflow, please see PostFlow (1a.) OUR WORKING SCHEDULE: We accumulate an estimated total of 112 hours a week, of active work hours. We reserve the right to work on personal projects during or after work hours. We reserve the right to a minimum mandatory 2 days off out of a regular 5-day work week. These are selected at our convenience. Holidays and personal events are also non-work days. (2.) PAYMENT POLICY: All payments are processed through PayPal invoices, so please provide a valid email address. Payment is required upfront unless otherwise agreed. You must pay the invoice before any work begins. Ensure you have the full payment amount ready before commissioning. If you cannot pay, your commission will be denied unless a payment plan is arranged for amounts over $100 USD. Do not send payment until all commission details have been discussed and confirmed. (2a.) Privacy Policy: We only collect your email address in order to handle payments. This is kept via Paypal for up to 5 years, for tax purposes. We do not collect or ask for your birth name, home address, or telephone number. However third-parties may collect information beyond our knowledge or consent. For more information please see, Privacy Policy (3.) WIPs AND UPDATES: WIP updates are not provided for smaller commissions like icons. Ensure you are available to discuss any desired changes during the sketch phase, as no WIPs will be given after final sketch approval. "WIP updates slow us down tremendously, and clog up the queue. Far too often clients are unavailable or uncooperative, and this has been our number one reason for no longer offering WIPS for smaller orders." For bigger orders: Half/Fully-bodies, You are permitted to one free major change (e.g., pose or character alteration) and two minor changes (e.g., ear size adjustment) during the sketch phase only. (3a.) ETAs (Estimated Time of Arrival/Completion.): "We are unable to provide loose estimates at any time, due to how we operate. To reduce stress on our end, it's simply done when it's done. You will be notified in the Telegram Channel, or by whatever original method you used to contact us about your order originally." 6 - 8 business weeks, not counting weekends, or holidays is the only real loose estimate we can provide. However this should not be used as binding on our part. (3b.) Deadlines and Priority If you require a deadline, you always have the option to pay an additional fee to obtain priority. Note: Impatience is not tolerated, and you will be recommended to go elsewhere, at the first sign of rushing to have an order done faster. (4.) REFUNDS AND EDITS: Refunds are not provided under any circumstances If we cancel your commission due to a breach of the TOS, no refunds will be issued. If we are unable to complete your commission, we may offer a full or partial refund, depending on the circumstances. If work has started, you will receive the completed portion along with a partial refund based on progress. Minor edits on finished artwork may be requested for an additional cost, but no edits will be accepted after 48 hours of delivery. Major edits will not be made to finished and approved artwork. Mistakes arising from unclear or low-quality references or descriptions are not the artist's responsibility, and any subsequent changes or edits will incur additional charges. (5.) OUR RIGHTS: We reserve the right to use commissioned artwork featuring your character for self-promotion, portfolio, and other purposes unless private commissions are agreed upon. We can cancel or refuse your commission at our discretion. We may reuse canceled, unfinished, or denied sketches and commissions, with edits to ensure the characters do not resemble those previously commissioned. (6.) YOUR RIGHTS: You may post the artwork publicly, crediting the original artist @CaffeinatedCultist. (please link back to one of our available socials.) You may request that your commission remains private before payment, and we will not post it on our platforms. You may ask the artist to move the watermark as long as it remains visible. (Please don't crop out the watermark.) You may not move, remove, or crop out our watermark, including zooming to hide it partially or fully. You may request the artist to crop a larger piece into an icon size, and a new watermark will be added. (additional fee may apply.) You are prohibited from editing or altering the artwork without the artist's permission (see edits policy (4.) You may not profit from our artwork in any way. You cannot claim the artwork as your own. Tracing or reselling our art is strictly forbidden. Physical merchandise of the commissioned artwork is permitted for personal use only; no commercial, private, or personal financial profit is allowed.
